A federal judge has ordered a class-action suit filed by the CVS and Walgreens that claims the company’s erectile dysfunction medication is not covered by insurance coverage.
In a decision issued Wednesday, the U. S. District Court in New York ordered the state to pay $2.8 million in a suit by CVS employees who claim they have been denied coverage for their erectile dysfunction medication because of allegedly insufficiency in insurance coverage for the product.
The suit, filed in U. District Court in Brooklyn, claims CVS’s erectile dysfunction drug, Cialis, and Walgreens’ Cialis Cialis Cialis Tablet are not covered by insurance coverage and is not effective.
The suit is in the first instance filed by CVS to pursue a class-action lawsuit brought by a class member that alleges the company is not covered by insurance coverage under the Food and Drug Administration drug benefit system and has a limited coverage and/or exclusivity on the drug. The suit is headed “Competition.”
The suit was filed in New York State Supreme Court.
In December, the CVS and Walgreens brought the suit against CVS for allegedly insufficiency in the insurance coverage for the drug. The suit alleges the CVS drug is not effective and was not covered by insurance.
CVS paid $1.2 billion to settle the case.
The lawsuit alleges that CVS and other drug companies failed to properly disclose the information on the product and failed to properly provide adequate information about the drug.
“This lawsuit alleges that CVS and other drug companies’ failure to disclose the drug information and failure to adequately warn consumers about the risks of using the drug,” said U. District Judge John D. Merian on Wednesday. “Our judgment is clear that the plaintiff’s damages are not sufficiently greater than they were in the CVS case in order for CVS to prevail.”
The suit also seeks a $2.8 million award against Walgreens for its failure to adequately warn consumers of the risk of using the drug.
In a statement to Reuters, Walgreens said: “In this case, the district court did not order a class-action or individual claim to be tried in this case. We are disappointed by the district court’s decision. We are taking action in the court’s interest and will continue to pursue this class-action or individual claim against the manufacturer of the drug.”
The CVS lawsuit is based on information provided to the Court by CVS’s CEO, who has called the drug “a lifesaver for men” in a “tremendous” sexual revolution, “a drug for everyone.”
The CVS lawsuit was filed on Dec. 18 in Brooklyn federal court.“For all of his work with the pharmaceutical industry, CVS has done a tremendous job of making a name for itself in the sexual revolution,” said Mark Stahl, CVS’s general counsel.
“CVS was not only the company that brought the drug to market, but the one that was the first-ever prescription drug to be approved by the FDA. As a result, CVS is now able to continue to market this new, highly effective, and very, very effective drug,” Stahl said.
The drug was originally developed by CVS as a heart medication and was first approved for erectile dysfunction in 1998. The drug was first introduced by the drug company CVS in 2003.
The lawsuit alleges that the drug is not covered by insurance and that CVS knew or should have known of the risks associated with the drug.
“In my experience, the most recent FDA review of CVS’s drug information showed that there is no indication that the drug is effective,” said U. District Judge William M. Seiter, who has taken a similar case before the court in recent years.
The suit also alleges that CVS failed to provide adequate warnings to consumers about the drug and failed to warn CVS to use the drug with caution or for no reason.
“This suit seeks damages as the jury must find that the defendants, the drug manufacturers, and their distributors knew of the risks associated with their product and failed to warn consumers about the dangers of using the drug,” Seiter said.
